Privacy Policy for Users

Marconi 150 – 84017 Positano (SA), VAT n. 05201280657 (hereinafter, the “Data Controller”), owner of the https://www.benvenutolimos.com internet site (hereinafter, the “Site”), in its capacity as data controller  with regard to the data of users who browse and register to the Site (hereinafter, the “Users”), provides the following privacy policy in compliance with art. 13 of Legislative Decree196/2003 (hereinafter, the “Privacy Code”) and with art. 13 of European Regulation 679/2016 of 27 April 2016 (hereinafter, the “Regulation”, the Regulation and the Privacy Code, together, being the “Applicable Legislation”).

This Site and the services offered through it are reserved for subjects who have attained majority. The Data Controller, therefore, does not collect personal data of minors. Upon request by the Users, the Data Controller will promptly delete all personal data of minors involuntarily collected.

1. Purposes of the data processing

The Users’ personal data shall be lawfully processed by the Data Controller in compliance with the provisions of art. 6 of the Regulation, for the following purposes:

  • Site browsing, in connection with the collection of necessary technical user data, such as, for instance, IP address, while the user is browsing the site.
  • Sending of newsletters, upon prior user request.
  • Answer to user enquiries received through the contact form.
  • Registration to the site reserved area, which gives access to the supplied services.
  • Legal requirements, that is to say, to fulfil obligations under the law, an authority, a regulation or European legislation.
  • Reception of curricula for staff selection purposes , through the relevant form. A specific policy shall be available in the relevant page.

The provision of personal data for the processing purposes mentioned above is discretionary, but necessary, as any failure to provide said data shall prevent the user from browsing, registering and enjoying the services offered by the Data Controller on the Site

2. Data processing method and retention period

The Data Controller shall process the Users’ personal data with manual and computer tools, using a logic that is strictly connected with the purpose of processing and always in such a way as to ensure confidentiality and the security of the processed personal data.

Personal Data concerning Site Users shall be processed for no longer than is necessary for the purposes detailed in paragraph 1 above, or, in any case, according to the requirements for the statutory protection of the interests of both the Users and the Controller. With regard to the purposes of paragraph 1.b above, data shall be stored until objection by the Data Subject to the sending of the newsletter, to be expressed through the link contained in the newsletter itself or by exercising their rights according to the provisions of paragraph 4.

3. Data communication and dissemination scope

The employees and/or collaborators of the Data Controller entrusted with the management of the Site may get to know the personal data of the Users. These individuals, who are formally appointed by the Data Controller as “persons in charge of processing”, shall process Users’ data exclusively for the purposes mentioned in this policy and in compliance with the provisions of the Applicable Legislation.

Additionally, third-party subjects who process data on behalf of the Data Controller in the capacity of “Independent Data Processors”, such as, without limitation, suppliers of computer and logistic services that are necessary for the operation of the Site, suppliers of outsourced or cloud computing services, professionals and consultants.

Users shall have the right to obtain a list of the data processors appointed by the Data Controller, by requesting it from the Data Controller as detailed in paragraph 4 below.

4. Rights of the Data Subjects

Pursuant to the Applicable Legislation, the Data Controller hereby informs Users that they an obtain information (i) on the source of the personal data, (ii) on the purpose and methods of the processing, (iii) on the logic applied to the processing, if the latter is carried out with the help of electronic means, (iv) on the identification data concerning the data controller; (v) on entities or categories of entities to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as data processor(s) or person(s) in charge of the processing..

Additionally, Users have the right to obtain:

access, updating, rectification or, where interested therein, integration of the data;

What cookies are
